A BILL to provide a stable method of financing the operation of
the Mason county public library, Mason County, West
Virginia, organized under chapter ten, article one of the
code of West Virginia, one thousand nine hundred thirty-one,
as amended.
Be it enacted by the Legislature of West Virginia:
MASON COUNTY PUBLIC LIBRARY BOARD.
§1. Levies by county commission and county board of education
to support Mason county public library.
In order to provide for the support, maintenance and
operation of the Mason county public library, Mason county, West
Virginia, and any and all branches thereof, the Mason county
board of education and the Mason county commission, hereinafter
described as the supporting agencies, shall, upon written request
by the Mason county library board of the Mason county public
library, levy annually on each one hundred dollars of assessed
valuation of the property taxable according to the last
assessment for state and county purposes, amounts as follows forthe fiscal year beginning the first day of July, one thousand
nine hundred ninety-four, and each succeeding fiscal year:
(a) By the board of education of the county of Mason: On
Class I property, sixty-eight one hundredths (68/100) of one cent
per hundred; on Class II property, one and thirty-six hundredths
(1.36) cents per hundred; on Class III property, two and seventy-
two one hundredths (2.72) cents per hundred; and on Class IV
property, two and seventy-two one hundredths (2.72) cents per
hundred.
(b) By the county commission of the county of Mason: On
Class I property, thirty-four one hundredths (34/100) of one cent
per hundred; on Class II property, sixty-eight one hundredths
(68/100) of one cent per hundred; on Class III property, one and
thirty-six one hundredths (1.36) cents per hundred; and on Class
IV property, one and thirty-six one hundredths (1.36) cents per
hundred.
Each year the Mason county library board shall request each
of the two supporting agencies to levy within the above rates on
each hundred dollars of assessed valuation of property of the
same class, and each of the two supporting agencies shall levy
within the rates aforesaid. In addition, each supporting agency
may contribute to the public library any other general or
specific revenues and excess levies. All income realized by the
operation of the public library from any sources other than the
above levies shall be used by the Mason county library board for
the support and maintenance of the public library.
§2. Disbursements.
All money collected or appropriated by the two supportingagencies for library purposes shall be deposited in a bank
account as directed by the Mason county library board and
disbursed by it for salaries, wages, books, other library
materials such as magazines, pamphlets, papers, works of art,
records, also machinery, equipment, supply services and other
cost and expenses of operating a public library and maintaining,
repairing, improving and replacing its property as well as
acquiring additional property.
§3. Status of employees.
All employees of the Mason county public library shall be
entitled to the benefits of the provisions of chapter twenty-
three and of articles seven and ten of chapter five of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended.
§4. Effect of future amendments of general law.
Amendments to article one, chapter ten of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, and
other general laws shall not control this act except to the
extent that they do not conflict with the special features
hereof, or unless the intent to amend this act is clear, specific
and unmistakable.
§5. Severability.
If any provision hereof is held invalid, such invalidity
shall not affect other provisions hereof which can be given
effect without the invalid provision, and to this end the
provisions of this act are declared to be severable.
§6. Deposit and disbursement of funds.
All money collected or appropriated by the two governingauthorities for library purposes shall be deposited on a
quarterly basis directed by the Mason county library board in a
bank or savings account specified by the board. All moneys
appropriated to the Mason county public library and all income
realized by the operation of the public library from any sources
other than the above levies shall be used by the Mason county
library board for the support, maintenance and operation of the
said public library and its branches.
The board is hereby vested with authority to accumulate a
surplus from year to year over and above the amount currently
required for the proper operation, maintenance and management of
the library. Such accumulated surplus may be used if and as
needed for support, maintenance and operation of the library, and
for capital improvements, additions or extensions to library
facilities.
NOTE: The purpose of this bill is to finance the operation
of the Mason County Public library.
